One can argue that there is no evidence to say Orange is not throttling- egg or chicken. Unless Orange comes out with a statement that they are or are not traffic shaping, both opinions are valid.
LLU is confirmed as underperforming- Maximum speed for most being 2.7-3 megs. With ADSLMAX these restrictions are not seen, hence in glenhills case, he can get 6meg. By Oranges behavior it stands to reason that having people on ADSLMAX is merely a stop gap before they can be shoved into the LLU network, during this period throttling people on ADSLMAX be it nationwide or on an individual exchange is necessary to cope with demand during busy periods.
Afterall, they are paying more for ADSLMAX, instead of paying BT more money to cope with demand, just throttle during busy periods- problem solved.
